Best Exhibitor’s Games Award Rules

gamescom latam (“Event”) is held by Gamescom Latam Ltda. (“Producer”), thanks to the sponsorship and support of the companies listed on the website latam.gamescom.global.

  1. The Event organizes, as part of its activities, Games Awards for the Event Exhibitors.
  2. Event Exhibitors’ Games are understood to be all games physically available to be played at booths in the area open to the general public of the Event or other specific areas of the Event (such as indie area, play next, among others). 
  3. The following games will not be able to participate in the Games Awards:
    1. Games available only in the business area (B2B) of the Event;
    2. Games available in any of the areas of BIG Festival, including Panorama Brasil and Panorama Mundo (there is a specific award for these games).
  4. To participate in the Awards, Exhibitors must submit information of their Games following instructions provided by the Event by email. All correctly registered Games will participate in the Awards. 
  5. The Event will make its best efforts to inform Exhibitors about the Awards, and cannot be held responsible for Exhibitors who for any reason are not aware of its existence – whether due to failures to receive the email or any other reason.
  6. The Awards have 5 different categories:
    1. Best Exhibitor Game: PC (for any game available on PC at the event);
    2. Best Exhibitor Game: Xbox (for any game available for Xbox consoles at the event);
    3. Best Exhibitor Game: PlayStation (for any game available for PlayStation consoles at the event);
    4. Best Exhibitor Game: Nintendo (for any game available for Nintendo consoles at the event);
    5. Best Exhibitor Game: Mobile (for any game available for mobile phones or tablets at the event);
  7. The choice of the winners will only take place by public vote. Voting may be taken:
    1. By participants of the physical Event, through voting kiosks available at the Event;
    2. Through voting in the online area of the Event (http://gamescom.com.br/online), which will be open to any visitor, even if they do not have access to the physical Event.
  8. Each category of the Award will have at least one winner, who will be the one with the most votes counted through the sum of online and kiosks votes. In the event of a tie, the Games with an equal number of votes will share the prize, which consists of a trophy.
  9. By submitting the Games for the Awards, the Exhibitors, or their representatives, expressly represent and warrant that they have all rights to take such action, i.e., that they have express authorization from the owners (or that they are the owners) of the rights for public display of the Games at the Event and on their Website, as well as for the entry of the Games in the Exhibitors’ Games Awards.
  10. By submitting the Games for the Awards, Exhibitors agree to assign to the Event, free of charge and for worldwide territory, all rights to use and distribute the promotional material of the Games for dissemination related to the Event in any format and in any media, including at the physical venues of the Event, on its Website and on third-party websites and publications. Also included in this assignment are the explanatory and illustrative materials sent from the Game, such as videos, photos, texts, interviews with the developers or professionals of the Games and other materials and information that have been sent, as well as logos and names of the publishers and/or studios of the Game.
  11. By submitting the Games to the Awards, the Exhibitor also undertakes to: 
  1. a) Not send any material that contains vulgar, defamatory, prejudiced images or sounds or that violate the Brazilian Penal Code and the applicable legislation; 
  2. b) Not to violate the privacy of others or to disrespect others racially, ethically, professionally or in any other way; 
  3. c) Not to violate any copyright or any other law when submitting the Game and other materials and information to the Event.
  1. By submitting the Games to the Exhibitors’ Game Awards, Exhibitors hold harmless or indemnify the Producer and third parties involved in the Event, as well as its partners, customers and sponsors, for all losses and damages of any nature arising out of or related to (i) the Entrant’s failure to comply with obligations under or related to these Rules, (ii) the legal violation generated by the Game(s) or other materials submitted,  and (iii) any fraud arising from the unauthorized use of third parties’ personal information for the purposes of entering the Awards.
  2. The Award does not fall within the modalities of free distribution of prizes provided for in Law 5,768/1971, Decree 70,951 and Ordinance 41/2008, and is therefore not subject to its terms, including with regard to the need to obtain prior authorization.
  3. These Regulations are governed by the laws of the Federative Republic of Brazil.
  4. The parties elect the Court of the District of the State of São Paulo, Capital, to settle any divergences arising from these Rules, with express waiver of any other, however privileged it may be.
